The Authorship Trap of the AI-generated Outputs in the Copyright Context

Abstract

This article explores the historical evolution of authorship, arguing that both the concept of authorship and the notions of originality are not fixed but are instead ever-evolving according to the social, economic, and technological needs. The concept of authorship needs to adapt to the “new normal”: human-computer interaction and human-computer symbiosis. While the aim of the copyright system to stimulate public creativity and human civilisation should remain unchanged, it is necessary to consider how the law will define this concept with the new situation that artificial intelligence has been significantly contributed during the creative process. A sui generis system is recommended to identify the interests and responsibilities of different involved parties.
