Liabilities In English Law Arising From Infiltration Of Stormwater.

    Abstract

    This paper will highlight the potential effects of recent modifications to the
    Environmental Protection Act 1990 to liabilities for infiltrated stormwater in the
    UK. The changes could severely affect statutory liability for the clean up costs of
    land contamination which might arise as a result of contaminants being transported
    to adjacent land by a badly planned or executed stormwater infiltration scheme.
    Particular attention is paid to the uncertainties in the way in which this modified
    legislation will be applied by regulators and interpreted by the courts and how
    liability under this statute compares with civil liability.
